Overview
Mr. Gunderman is a trial attorney with experience representing clients in a variety of litigation matters. He works with clients to find creative solutions to their problems in matters involving personal injury, premises liability, professional liability, commercial auto and trucking, first-party insurance claims, toxic tort and environmental law, oil and gas property rights, product defects, and wrongful death.
Mr. Gunderman's experience includes participating in multiple jury and bench trials, drafting and arguing dispositive motions, managing discovery, conducting witness interviews, preparing and presenting witnesses for depositions and trials, and mediation and settlement negotiations.

Representative Matters
- Defended real estate brokerage in arbitration involving alleged breaches of fiduciary duties and breach of contract, while asserting successful counterclaims and recovering all client’s attorneys’ fees and case expenses
- Authored successful appellate response briefing in Texas’ 8th Court of Appeals, in which a trial court’s summary judgment was affirmed on behalf of real estate broker as to claims of fraud by nondisclosure, breach of fiduciary duty, breach of contract and Texas DTPA violations, in addition to trial court’s award of attorneys’ fees as a prevailing party as to DTPA claims.
- Represented Oil & Gas company regarding enforcement of right of first refusal as to overriding royalty interests. The 6th Court of Appeals in Texarkana ruled that a settlement agreement referenced in a recorded assignment of overriding royalty interests as to over 100 oil and gas leases and giving the client company a right of first refusal on any sale of the leases was a covenant running with the land and binding on the original parties' successors.
