Appellate Win
We are pleased to share that the Louisiana Fourth Circuit Court of Appeal has reversed the trial court and rendered summary judgment in favor of our insurer client in a coverage dispute arising from the catastrophic collapse of a residential structure undergoing substantial renovations.
The court held that the policy’s breach of contract exclusion applied not only to claims expressly brought for breach of contract, but also to all negligence claims that were inextricably tied to the insured’s contractual obligations.
