Brown Sims Achieves Complete Dismissal With Prejudice in Federal Offshore Injury Case

Brown Sims is pleased to announce that attorneys Michael Williams, John Davis, and Nicholas Cenac recently obtained a complete dismissal with prejudice on behalf of their client in a matter pending in the United States District Court for the Southern District of Texas- Houston Division.

The case involved an alleged injury on an offshore platform. The plaintiff named multiple defendants, including our client, but the complaint failed to allege any specific facts connecting our client to the incident. Our team moved to dismiss under Federal Rule of Civil Procedure 12(b)(6), arguing that collective references to "Defendants" without particularized allegations are insufficient under Fifth Circuit pleading standards.

The District Court agreed, granting the motion and dismissing all claims against our client. The plaintiff subsequently filed a Motion for Reconsideration and an Alternative Motion for Leave to Amend. The Court denied both, noting that the plaintiff had already been afforded one opportunity to cure the pleading deficiencies.
