Brown Sims Secures Summary Judgment Win in Harris County

Brown Sims President Robert M. Browning, Shareholder William Danny Abbott, and Associate Nicholas M. Knowles recently obtained full summary judgment in a Harris County District Court in defense of a nationwide vegetation management company. The plaintiff claimed to have sustained serious injuries when a piece of debris struck his eye, causing him permanent partial blindness. Plaintiff brought suit against the defendant arguing that it was his employer and responsible for causing his injuries. Brown Sims sought summary judgment on the grounds that the vegetation management company was not Plaintiff’s employer and did not control any aspect of the project.  Additionally, even if the management company was Plaintiff’s employer, then the Texas Labor Code provides the sole remedy for the plaintiff, thereby precluding the claims in the lawsuit. The Texas court rejected the plaintiff’s claims and granted full summary judgment in favor of the defendant.
