Congratulations to Cody Frank and Marlin Green on securing an appellate win before the U.S. Court of Appeals for the Fifth Circuit.
Following oral argument, the court affirmed the district court’s dismissal of a maritime insurance coverage action involving a named-operator exclusion. Applying New York law, the Fifth Circuit found that the vessel at issue qualified as “ocean-going,” rendering the exclusion enforceable and precluding coverage under the policy.
