Congratulations to attorneys Marlin Green and Cody Frank on securing a notable Eleventh Circuit result in a high-stakes maritime insurance dispute.
The case centered on a yacht grounding off the Dominican Republic’s northern coast, near Puerto Plata, that led to a prospective $9.7 million repair cost award along with exposure for fees and costs. Our appellate team showed that the policy capped recovery at the reasonable value of the damage rather than actual expenses incurred by the insured and that the trial court’s damages ruling went too far.
The Court agreed, affirming key coverage findings for our client, vacating the overreaching award, and remanding for further proceedings under the proper standard. See the brief here:
