Summary Judgment Granted in Maritime Limitation Case
Congratulations to shareholder Cody Frank for obtaining summary judgment for a marina client in a maritime limitation of liability action in the U.S. District Court for the Southern District of Florida arising from a fatal commercial diving accident.
Cody played a central role in developing the factual record that ultimately proved decisive. Through on-site inspection of the marina and vessel and careful development of the evidentiary record, the defense was able to present the Court with a clear picture of the events at issue.
That record mattered. The Court found that the marina “persuasively argued” that no facts established proximate causation and held that no reasonable factfinder could conclude that the marina proximately caused the diver’s death.
