Mississippi Court of Appeals Affirms Complete Dismissal of Wrongful Death Suit

We’re proud to announce that the Mississippi Court of Appeals has affirmed summary judgment in favor of our client, IMS Engineers, Inc., fully dismissing all claims in a wrongful death lawsuit stemming from a tragic motor vehicle accident in Jackson, Mississippi.

Plaintiffs alleged the accident was caused by an unseated manhole cover and aggressively targeted IMS throughout years of litigation. The case drew significant media attention and involved extensive discovery, including 38 depositions and broad inquiry into IMS’s role in the City’s capital improvement program.

Both the trial and appellate courts agreed: IMS owed no legal duty at the time of the incident, having been removed from the project nearly a year prior. The appellate court further held there was no evidence linking IMS to the creation or approval of the hazardous condition.

After years of litigation and public scrutiny, our client’s position—and its professional reputation—have been fully vindicated.
