Experience

Representative Matters

  • Louisiana First Circuit Court of Appeal affirmed summary judgment in favor commercial insurer client finding that that the policy’s breach of contract exclusion unambiguously precluded coverage for property damage allegedly caused by defective construction work performed by subcontractors.
  • Secured summary dismissal with prejudice of all claims alleging bad faith and breach of duty under Louisiana’s Insurance Code and Civil Code against surplus lines broker client.
  • Successfully secured summary judgment for a major airline client in a personal injury and defamation lawsuit where plaintiff sought seven-figure damages by demonstrating that the claims lacked factual and legal merit, leading to a full dismissal with prejudice.
  • Obtained summary judgment securing a complete dismissal of all claims against a commercial insurer in a construction defect and insurance coverage dispute. The plaintiffs sought coverage under a commercial general liability policy for alleged defective construction work, breach of contract, and negligence. We successfully argued that the policy’s exclusions—including those for breach of contract, faulty workmanship, and classification limitations—precluded coverage.
  • Obtained summary judgment in a maritime insurance coverage dispute where the plaintiff sought compensatory and punitive damages by demonstrating that the insurer acted reasonably in denying additional payments after a thorough investigation and expert medical analysis showed no basis for further liability.
  • Represented children’s car seat manufacturer against defective-design product liability claims, emanating from a catastrophic accident that left a young child paraplegic. Plaintiff’s counsel, who had recently secured an eight-figure trial recovery based on similar claims and injuries, estimated the value of plaintiff’s damages at a comparable amount. Brokered a voluntary dismissal of all claims, without payment of any consideration, after questioning the reliability of plaintiff’s engineering expert’s opinions in light of contradictory forensic evidence
