Houston Associate Neal Hoffman’s publication of his opinion article on Texas’ new spoliation rules was featured in the April 2015 Texas Bar Journal. The article addresses the impact that the Texas Supreme Court’s opinion in Brookshire Bros. Ltd. v. Aldridge will have on litigants seeking or facing charges of spoliation. The article addresses when the duty to preserve evidence arises, the standards for pursuing negligent spoliation claims, and new limitations on spoliation instructions.
